Terms of use

These terms of use govern your use of PlatoScience ApS’, CVR-nr. 37065226, (“PlatoScience”, “we”, “us” ,”our”) website http://www.platoscience.com (the “Site”), including the online shop at http://www.platoscience.com/shop (the “Plato Shop”), and the digital application called PlatoWork provided by PlatoScience (the “Plato App”) (collectively referred to as the “Plato Services”).

Please read these terms of use carefully before you start to use the Plato Services. Your access to and use of the Plato Services and/or any material which is contained in or which may be accessed, downloaded, installed and/or copied via the Plato Services is conditioned on your acceptance and compliance with these terms of use. You acknowledge and agree to abide by these terms of use by 1) accessing or using the Site and the Plato Shop and/or 2) downloading and using the Plato App. If you do not agree to these terms of use, please do not use the Plato Services, leave the Site or Shop, uninstall the Plato App and delete any material which you have gained access to via the Plato Services.
1. Information about us
1.1. PlatoScience provides an online platform on which you can purchase a neurostimulation headset that sends electrical micro-currents to stimulate your brain and prompting you in the right mindset for the task at hand (the “Product”).
1.2. We are a private limited company registered in Denmark and our principle place of business is at c/o Republikken, Vesterbrogade 26, 1620 Copenhagen V, Denmark.

2. The PlatoScience Services
2.1. Access to the Plato Services are permitted on a temporary basis, and we reserve the right to withdraw or amend the content, products, programs, etc. which we provide via the Plato Services without notice. We will not be liable to you if for any reason the Plato Services are temporarily unavailable at any time or for any period.
2.2. From time to time, we may restrict access to some or all parts of the Plato Services.
2.3. You are responsible for making all arrangements necessary for you to have access to the Plato Services. You are also responsible for ensuring that all persons who access the Plato Services through your internet connection are aware of these terms, and that they comply with them.

3. Third Party software
3.1. PlatoScience uses third-party software on the Plato Site, such as the open-source e-commerce plugin “WooCommerce” and “Stripe” to handle payments. Any such third-party software is outside of scope of these Terms of Use. You accept that PlatoScience is not responsible for such third-party software or for assessing any third-party content and use of third party software is solely at your own risk.

4. Using the Plato Shop
4.1. Please go to https://platoscience.com/shop/ to browse the Plato Shop.
4.2. To order any item simply click the “Add to basket” icon to add the Product to your shopping basket. Once you have finished shopping, please click on the “View basket” and proceed to check out. Please follow the instructions on screen to complete your order.
4.3. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending an order confirmation acknowledging that we have received your order, Only when the transaction is completed and the confirmation is sent by us, the sale is concluded. Please note that the availability of certain Products may be limited, and Products may not be available for immediate sale.
4.4. Any purchase on the Plato Shop will be governed by our Terms and Conditions of Sale.
4.5. We do keep a copy of the order details of your purchase which is available on request to [email protected]
4.6. You may correct any input errors on the checkout page only. Please make sure the information you provide is correct before placing the order. In case of any errors occur during a purchase, please contact us on [email protected]
4.7. The purchase may be conducted in English.
4.8. You may not use the Plato Shop or its contents:
• for commercial purposes;
• for resale purposes including the systematic extraction and/or re-utilization of any part or the contents of the Plato Shop (e.g. item listings, descriptions, prices);
• to download (other than page caching) or modify the Plato Shop, or any portion of it; or
• for any purpose which is unlawful.
4. using the plato app
4.1. The PlatoWork app is available for iOS (version 10.0.0 and later) and Android (version 21 Lollipop and later). The PlatoWork app is used to control the PlatoWork headset. This includes managing sessions and storing usage data. The app requires the user to set up an account providing email and password.

5. Intellectual property rights
5.1. We are the owner or the licensee of all intellectual property rights related to the Plato Services, and the material published on these services. The Plato Services and the published material are protected by copyright, trademark, database rights and/or other intellectual property rights. All such rights are reserved.
5.2. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any materials, including but limited to, illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
5.3. If you print off, copy or download any part of the Plato Services in breach of these terms of use, your right to use the Plato Services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
5.4. Using the Site does not give you permission to link to it or to use any of the trademarks, designs, get-up and/or logos contained within it.
5.5. The Plato Services and all logos on such services are business names and marks which are the property of PlatoScience.

6. Regular changes
6.1. We aim to update the Plato Services regularly and may change the content at any time. If the need arises, we may suspend access to the Plato Services or close it indefinitely. Any of the material on the Plato Services may be out of date at any given time, and we are under no obligation to update such material.

7. Limitation of liability
7.1. The Plato Services are provided “as is”. Whilst we have taken every care in the preparation of the content of the Plato Services, we cannot guarantee that it is accurate or error-free. We will not be responsible for any errors or omissions or for any technical difficulties you may experience with the Plato Services.
7.2. Except as set out in this clause 7, all conditions, warranties and representations, expressed or implied by statute, common law or otherwise, in relation to the supply, non-supply or delay in supplying the Plato Services are excluded to the extent permitted by law.
7.3. We shall not be liable to any person for any loss or damage which may arise from the use or misuse of the Plato Services, including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill. Nothing in these terms of use shall operate to exclude or restrict our liability for:
• death or personal injury resulting from negligence;
• fraud or deceit; or
• for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

8. Information about you and your use of the Plato Services
8.1. We process information about you in accordance with our Data Privacy Policy. By using the Plato Services, you consent to such processing of your personal data and you warrant that all data provided by you is accurate.

9. viruses, hacking and other offenses
9.1. You must not misuse the Plato Services by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Plato Services, the server on which the Plato Services are stored, or any server, computer or database connected to the Plato Services. You must not attack the Plato Services via a denial-of-service attack or a distributed denial-of-service attack.
9.2. By breaching this provision, you may commit a criminal offence. We may report any such offence to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Plato Services will cease immediately.
9.3. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer or phone equipment, computer programs, data or other proprietary material due to your use of the Plato Services or to your downloading of any material posted on our Site or on any website linked to it.

10. Links from the Plato services
10.1. Where the Plato Services contain links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. WAIVER
11.1. If you breach these terms of use and we take no action, we will still be entitled to use our rights and remedies in other situations where you are in breach.

12. ALTERATIONS TO THESE TERMS OF USE
12.1. We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on the Plato Services.

13. Law and jurisdiction
13.1. These terms of use (and any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relating to these terms of use or their formation) will be governed by and be interpreted in accordance with Danish law.
13.2. Any dispute, difference or controversy arising between PlatoScience and you with respect to the construction, interpretation or application of the Plato Services and/or these terms of use, which cannot be solved by direct negotiation and amicable settlement, will be brought before the Danish courts.
